Welcome to Blystone Media Group. These Terms of Service (“Terms”) govern your access to and use of the Blystone Media Group website, including its pages, photographs, graphics, articles, videos, links, forms, galleries, and other content made available through the website.

Throughout these Terms, “Blystone Media Group,” “BMG,” “we,” “us,” and “our” refer to Blystone Media Group. “You” and “your” refer to any visitor or user of this website.

By accessing or using this website, you agree to these Terms. If you do not agree with these Terms, please do not use the website.

1. Purpose of This Website

The Blystone Media Group website provides information about our photography, media, creative, and related services and may provide access to portfolios, news or event coverage, client galleries, online stores, contact forms, and other resources.

Information presented on this website is provided for general informational and promotional purposes. The availability, scope, pricing, and conditions of specific services may change.

2. Separate Client and Purchase Agreements

These Terms govern general use of the Blystone Media Group website.

Photography sessions, media services, commercial work, event coverage, print purchases, digital downloads, licensing, and other transactions may be governed by additional agreements or policies, including contracts, proposals, invoices, model or property releases, gallery terms, Terms of Sale, Digital Image Licenses, or other written agreements.

When a specific written agreement or transaction-specific policy conflicts with these general website Terms regarding that particular service or transaction, the more specific agreement or policy will control.

3. Copyright and Ownership

Unless otherwise stated, photographs, videos, graphics, logos, written material, designs, layouts, and other original content displayed on this website are owned by Blystone Media Group or are used with permission from their respective owners.

Blystone Media Group photographs and other original creative works are protected by United States copyright law and other applicable intellectual-property laws.

Displaying an image on this website, in a gallery, on social media, or elsewhere online does not place that image in the public domain and does not transfer copyright or grant a license to use the image.

Unless BMG has given you express permission or a license allowing otherwise, you may not:

  • Copy, reproduce, download, screenshot, distribute, publish, or repost BMG photographs or other protected content;

  • Remove, obscure, crop out, alter, or attempt to defeat a watermark, copyright notice, attribution, metadata, or other rights-management information;

  • Use screenshots or other methods to obtain or distribute an image in place of purchasing or properly licensing it;

  • Sell, sublicense, redistribute, or commercially exploit BMG content;

  • Alter a photograph and present the altered version as an authorized BMG work;

  • Use BMG photographs, videos, or other content for advertising, merchandise, promotional materials, publications, or commercial purposes without appropriate permission;

  • Scrape, systematically download, archive, harvest, or reproduce website or gallery content; or

  • Use BMG content to create, train, develop, test, or improve artificial-intelligence, machine-learning, facial-recognition, image-generation, or similar systems or datasets without prior written authorization.

Purchasing a print or digital file does not automatically transfer copyright. Any rights granted with a purchased digital image are determined by the applicable Digital Image License or other written agreement.

4. Personal Sharing and Licensed Use

Certain photographs may be provided or sold with permission for personal use or social-media sharing. Any such permission is governed by the license accompanying the photograph, gallery, purchase, or client agreement.

Permission to share one photograph does not create permission to use other photographs.

When attribution, watermark preservation, or other conditions are included in a license, those conditions must be followed.

5. Media and Event Coverage

Blystone Media Group may photograph or otherwise document public events, sporting events, community activities, school activities, ceremonies, performances, and other events as part of its photography and media work.

Photographs or media appearing on this website may therefore include event participants, spectators, public officials, athletes, students, staff members, volunteers, or other individuals.

Questions or concerns about an image appearing on the website may be submitted through the Blystone Media Group contact page. BMG will review reasonable requests but does not guarantee removal unless removal is required by law, contract, or another applicable obligation.

6. Website Content and Accuracy

BMG attempts to provide accurate and current information. However, we do not guarantee that every description, price, date, availability statement, photograph, link, or other item appearing on the website will always be complete, current, or error-free.

We may correct errors or update website information at any time.

Nothing displayed on the website by itself guarantees availability or constitutes a binding offer to provide services.

Submitting information through the website does not, by itself, create a photographer-client, contractor-client, employment, or other professional relationship.

Parts of the BMG website may link to or use services operated by third parties, including services used for client galleries, print fulfillment, online stores, website hosting, forms, payments, social media, maps, video, or other functionality.

For example, BMG may provide links to galleries or stores hosted through Pixieset.

When you access a third-party service, your use of that service may also be governed by that provider's terms, privacy policy, cookie policy, and other rules.

BMG is not responsible for the availability, security, policies, content, or operation of an independent third-party website or service.

10. External Links

The website may contain links to news organizations, schools, athletic organizations, businesses, social-media platforms, community organizations, or other third-party websites.

A link does not necessarily constitute an endorsement of that organization, website, product, statement, or service.

BMG is not responsible for content or activity occurring on third-party websites.

11. Trademarks and Branding

The Blystone Media Group name, logos, branding, and other identifying marks may not be used in a manner that falsely suggests sponsorship, authorization, partnership, or endorsement by BMG.

We do not guarantee that the website, galleries, links, downloads, or other online services will always be available or operate without interruption.

BMG makes no warranty that the website will be uninterrupted, error-free, completely secure, or suitable for every particular purpose.

Nothing in this section limits warranties or rights that cannot legally be excluded.

To the fullest extent permitted by applicable law, Blystone Media Group will not be liable for indirect, incidental, special, consequential, or similar damages resulting solely from the use of, inability to use, or reliance upon this website or third-party services linked from it.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

Rights and obligations arising from a photography contract, purchase, license, or other separate transaction are governed by the agreement applicable to that transaction.

Use of this website is also subject to the Blystone Media Group Privacy Policy, which explains how information associated with website visitors may be collected, used, shared, and protected.

16. Copyright Concerns

If you believe material displayed by Blystone Media Group infringes a copyright or other intellectual-property right that you own or are authorized to represent, please contact BMG through the website and provide enough information for us to identify and evaluate the material in question.

Likewise, unauthorized use of Blystone Media Group copyrighted material may be addressed through platform copyright-reporting systems, Digital Millennium Copyright Act procedures where applicable, direct enforcement, or other remedies available under law.

These Terms are governed by the laws of the State of Iowa and applicable federal law, without regard to conflict-of-law principles.

To the extent permitted by law, disputes relating specifically to use of this website will be subject to the jurisdiction of courts having proper jurisdiction in Iowa.

Blystone Media Group may revise these Terms as its website, services, technology, or legal obligations change.
